Read that. Read all of it. Not just the legalese in white. Not just the “skimmer-friendly” version in gray. Read both and notice how they technically, for all legal purposes, say the same things…yet completely contradict one another from any practical standpoint. The gray boxes are all nice and friendly. Ok:

1) You can’t create content and post it to tumblr w/o it automatically becoming copyright protected. Thanks to the Berne Convention as soon as any work is “fixed” (so recorded in some sort of physical medium) copyright is granted to the author. The act of writing something in the post creation box satisfies the requirements of fixing a work.

2) If you’d actually read the terms of service it specifically mentions:

The reference in this license to “creat[ing] derivative works” is not intended to give Tumblr a right to make substantive editorial changes or derivations, but does, for example, enable reblogging, which allows Tumblr Subscribers to redistribute Subscriber Content from one Tumblr blog to another in a manner that allows them to add their own text or other Content before or after your Subscriber Content.

There is also a part after this that allows third parties to syndicate tumblr content for which reasonable examples are given.

So yeah, less freaking out and more reading please.
